The following text is problematic:

I would suggest

* clarify that the final legal language should ensure that ICANN has the
authority to enforce
i) Consensus Policy as defined in Specification 1, and made in
accordance with these Bylaws,
ii) voluntary TLD applicant commitments the achievement of which is
within the scope of the Mission and consistent with these Bylaws.

Or, if you want it in plain English:

Clarify that enforcement of contractual terms is available for
activities that are consistent with the Mission and Bylaws, without
suggesting that the scope what is permitted by the Mission and Bylaws is
expanded merely by writing it into a contract with a Registry or Registrar.
