[Area 4] Comments from Mr. Kavouss Arasteh (GAC, ICG)

Dear WG 4,
the contingencies I see in addition to what has been mentioned are likely - if at all - WS 2 issues:

- The Board receives conflicting recommendations / advice from different SOs and ACs as we have seen with the IGO/INGO recommendations and the partially conflicting GAC advice. This can be resolved under the bylaws, but that would require refusing one of the group’s advice or recommendations. I am not aware of any mechanism to help mitigate or expediently resolve such matters. I am more than happy to elaborate more if this is too short, but I would imagine that we will see more of such scenarios and they might become an issue for the security and stability in case SSAC advice is concerned.

- Don’t you think there could be cases where the ICANN Board of Directors, which is the Board of the ICANN Corporation (and not the ICANN community) might prefer to act in the interest of the corporation and not the community to avoid liability?
