I tend to agree with James wrt this point, on the basis that since the 
Auction funding is 501c3 mission-constrained on the disbursement front 
down to the final recipients, no matter how many intermediaries there 
are in between, I don't see how it could be constraint-free on the 
us-legal company front along the same lines (that is: if ICANN gives 
fund to a legal partner that itself gives it to an illegal one, ICANN is 
still liable).
