<p>1. PTI is not subject to EC power by virtue of being an affiliate of ICANN. The EC's power is within ICANN. Of course, the ICANN Bylaws allow the EC to address issues that relate to PTI, but that is because the powers are granted through the ICANN Bylaws
and not solely by virtue of PTI's relationship with ICANN. For example, the EC has the ability to reject the IANA Budget, which is an ICANN-developed budget. PTI separately has the PTI budget (that is subsumed in the IANA Budget) but the EC does not have
specific rejection rights over the PTI budget/the PTI Bylaws-specified process for approval of that budget. The EC also has specific powers regarding how the ICANN Board considers recommendations from the IANA Naming Function Review, but those powers are
applicable against ICANN as the IANA Functions Operator and the holder of the contract with PTI, and not against PTI. If there was a separate foundation created, the EC would similarly only have powers as it relates to ICANN, and not over the separate foundation.<br>

<p>As this is likely to be implemented, across all potential mechanisms (A, B, C), what would appear in ICANN's budget and planning documents would be a more high-level annual amount attributed to the program. Under each of these mechanisms, there would be
an amount allocated for the annual tranche, as well as an amount for ICANN's administration of the mechanism. This administration amount will vary based on the level of involvement ICANN has in the mechanism. It is this annual amount that could be placed
at issue in the EC's budget/plan rejection power. I do not anticipate that under any mechanism the ICANN Budget would contain detail on a grant-by-grant basis sufficient to allow the EC to challenge individual grants through the budget rejection process. </p>

<p>To date, we have not had conversations amongst the CCWG as to how the CCWG recommends the EC powers to be exercised. If ICANN implements the AP program as recommended, does the CCWG have any recommendations as to the EC's ability to challenge the funding
