I would like to comment on the very interesting discussion, if<br>
inconclusive discussion we had in Marrakech, as alumni of ATRT2 and<br>
actual member of CCT1. My 2 cents:<br>

1. The most important issue this year is how the AoCs will be<br>
incorporated into the By Laws, as we all expect the AoC to lapse. If<br>
they are going to be incorporated more or less verbatim, meaning keeping<br>
a large margin for interpretation, or if in this opportunity more<br>
stringent definition of the reviews will be developed.<br>
<br>
<suggestion><br>
We should define ASAP as GNSO team that will collect feedback from<br>
previous Review Teams and try to follow up as closely as possible the<br>
implementation of the AoC into the By Laws<br>
<br>
2. Another important issue with the Reviews, is the very slow startup<br>
phase in terms of budget, charter or Terms of Reference, progress<br>
reviews since the last exercise, etc. In case of the ATRT2 it took a few<br>
months to find out we had little funds. in case of the first CCT we have<br>
funds but the external Studies by Analysis and Nielsen are pretty much<br>
delayed.<br>
<br>
<suggestion><br>
In the meantime Staff should prepare yearly progress reports on progress<br>
in implementation of Review recommendations, simultaneously at a fixed<br>
date EVERY the year. Lets say June 30. Based on those yearly reports SOs<br>
and ACs would have a common ground for discussion on future reviews<br>
planing and budgeting every time it is necessary.<br>

Look forward to other comments and suggestions before or on April 14.<br>

Following up from our discussions in Morocco, the next phases of AOC<br>
Reviews for Accountability and Transparency (ATRT3) and WHOIS (WHOIS2)<br>
will be kicking off this year. (See attached slide for schedule).<br>

During our weekend sessions in Marrakech, we discussed the challenges<br>
& wisdom of launching these reviews now, given that substantial work<br>
on both topics is already in progress. Also, our update from ICANN<br>
Staff made it clear that Staff would not act unilaterally to delay or<br>
postpone any scheduled AOC review, particularly in the absence of<br>
consistent guidance from the Community.<br>

We did not reach any decision at ICANN55. In my view, our options<br>
are:<br>
<br>
(1) Take no action. The likely outcome is that the AOC Reviews (ATRT3<br>
and WHOIS2) will commence as planned.<br>
(2) Consult informally with other SO/ACs and the Board to get a sense<br>
of similar concerns shared by other organizations in the Community.<br>
(3) Draft a letter to the Board/Staff, copying other SO/ACs, outlining<br>
our concerns about potential overlap/redundancy of upcoming AOC<br>
reviews with ongoing work on Accountability and WHOIS.<br>
<br>
We can flag this topic for discussing during out next Council call (14<br>
APR). However, the agenda for this meeting is starting to fill up, so<br>
it would be immensely helpful if we could discuss on the list and<br>
arrive at a decision.<br>
