Thanks Marika and Jonathan for this final drafts for work today.

 

I am in Zanzibar and unfortunately, the connectivity is really not good at all. I am unsure if I will be able to join the call, will certainly try. I do not have major objections about the latest draft that was shared by Jonathan. 

 

However, there are a couple of points that I believed have changed during this edit that need to be revised:

 

On page 3, the item reads: 

 

&#8226              To align with requirements imposed to maintain ICANN’s U.S. tax exempt status, the CCWG must include a limitation that funds must not be used to support political activity/intervening in a political campaing public office  or attempts to influence legislation . The definitions of the limitations that are imposed to meet U.S. tax requirements must be applied across all applicants, and not only those from or intending to use the funds within the U.S.

 

My comment is that although I appreciate the details and the links to the US tax requirements, I think on the edition, we lost the idea that the funds were not supposed to be used for the same 2 reasons mentioned above (campaigning and lobbying) at the international level. The way it is worded now, reads like funds might be used to influence policy and lobby in other countries, as long as they don’t do it in the US. That was not the spirit of the discussion. The restrictions we talked about also meant to apply not only across all applicants, but across their own jurisdictions.

 

On page 4, under scope, the item reads:

 

4.         Auctions derive from a single source, the new gTLD auction proceeds round I. The timeframe for the operation of this new mechanism is unknown but it may provide the opportunity to support projects over a longer period of time e.g. with funding released in tranches linked to project milestone achievements. Therefore, consideration needs to be given to the expected timeframe in order to allow for (depending on the character of the individual project) single and multiple disbursements, depending on the length of the individual project?

 

There is no need to include on this item that “Auctions derive from a single source, the new gTLD auction proceeds round I.” as the paragraph is referring for the timeframe to allocate of funds not about where they come from. As some of the funds allocation might actually go to support processes or organizations (not projects) I think the language around projects should not be included and the item 4 to be phrased as a clear question. 

 

My suggestion to change the text is:

 

4.         What aspects should be considered to define a timeframe for the funds allocation mechanism to operate? E.g. The timeframe for the operation of this new mechanism may provide the opportunity for long term support, or for funding to be released in tranches linked to milestone achievements, single or multiple disbursements.

I have made an editorial review of the document and, I trust, improved the clarity or detail in various places.

 

In addition to the editorial changes (all visible in the attached redline), I have highlighted one are which I edited.

At minimum, I’d like to discuss the highlighted area and the edits made in this area in order to ensure that they are consistent with what was intended.

 

Look forward to wrapping up this draft tomorrow and committing to the schedule ahead.

Please find attached for your review the latest version of the new gTLD Auction Proceeds CCWG Charter which includes the edits discussed during the DT’s call earlier this week as well as those items that were assigned to Sam and Erika (note, all previous changes were accepted and comments addressed removed). Please review this version and flag any items you think require further DT discussion before the next DT meeting which has been scheduled for Friday 9 September at 14.00 UTC. 

 

As discussed, in relation to next steps, the proposed timeline is as follows:

 

·         2 September – circulation of ‘final’ version of charter

·         9 September – deadline for any further edits / comments (a DT call has been scheduled to resolve any remaining issues, if needed)

·         12 September – submit proposed charter to ICANN SO/AC with the request to identify any items that would prevent adoption of the charter by 30 September at the latest, including an indication of when the SO/AC may be able to consider the charter for approval if it is confirmed by 1 October that there are no changes to the charter.

·         October/November – adoption of charter by SO/ACs

·         December – first meeting of CCWG
