Hello James and everyone,

Assuming there is no hindrance (e.g. in the form of a ccNSO member’s objection in the few hours we have left until 06.59 UTC on 21 July), then, yes, the amendment will pass successfully, whether or not the GAC decides to support, object or abstain.

Once we have confirmation from the ccNSO that their approval vote remains unchanged, and we hear from the GAC as to their final decision, this information can all be plugged into the draft notice for one of you to send (e.g. Stephen?). Hopefully all that can take place before the end of the work day for most on Friday (tomorrow).

As you know, the 24-hour period for the Empowered Community Administration to notify the ICANN Secretary of the results of the ongoing action process relating to the transference of the Board Governance Committee’s responsibilities for overseeing Reconsideration Requests to a new Board committee will commence at 07:00 UTC on 21 July and expire 24 hours later on Saturday 22 July. To follow up on the reminder sent previously (see below), staff has taken the liberty of preparing a draft template for an Approval Action Notice for your review (attached).

As of 01:00 UTC on 21 July 2017, we have received notifications of approval from the ASO and GNSO, and are awaiting the formal notice from the ccNSO - we understand that the ccNSO Council has already approved the amendment and are currently in the waiting period to see if any ccNSO members object to that decision. We are also awaiting formal notification from the ALAC and the GAC on the result of their internal decision-making process concerning this matter.

Please note that the draft notice attached to this letter was based on the scenario where the requisite support threshold has been reached (i.e. support from at least 3 of the 5 Decisional Participants, and objection by no more than 1 Decisional Participant). If that turns out to be the case, the blank spaces will need to be filled in with the updated numbers. Of course, should it turn out that the approval threshold is not reached, the draft will have to be amended accordingly.

We hope this is helpful. Given the upcoming weekend and the fact that a few Empowered Community Administration members have indicated that they will be away starting from this weekend, we hope it will be possible for one of the others to send the requisite notice to the ICANN Secretary on behalf of the Empowered Community Administration.

Dear members of the Empowered Community Administration,

This note is just to place two dates on your calendars:

  *   First, 06.59 UTC, 21 July 2017 – this is the final day, for the five Decisional Participants who comprise the Empowered Community, to notify you as the Empowered Community Administration as to whether their respective community groups support the proposed Fundamental Bylaw amendment regarding transference of the Board Governance Committee’s responsibility for Reconsideration Requests to a new Board committee.
  *   Secondly, 06.59 UTC, 22 July 2017 – this is the expiration of the 24-hour period following the end of the decisional phase above, by which time the Empowered Community Administration needs to notify the ICANN Secretary as to whether the amendment has been approved by the Empowered Community, or if the approval process has been terminated due to lack of the requisite community approval.

As you know, approval of the Fundamental Bylaw amendment requires the support of at least three Decisional Participants, with no more than one Decisional Participant objecting.

Staff will send a similar reminder to the Chairs of each of the five Decisional Participants. We will also follow up with you toward the end of the decisional phase to ensure that we have the requisite formal notification letter in place for your approval.
