Dear Xavier,

further to our recent conversation, I must sadly inform you that it will
be impossible for the ALAC to submit a statement in the unreasonably
short amount of time (24 days) which were allocated for the Public
Comment process. The ALAC's statement will therefore be submitted
post-deadlines.

This issue of short comment period is one which does not only affect
your public comment period, but also many others. The matter is already
being taken up with the Public Participation Committee. As discussed
with you, I appreciate that you will be able to show some flexibility
regarding our forthcoming comment if you are able to access our draft
statement in advance.
To this effect, please find below the call for comments based on our
first draft that I have just sent out to our lists. It links directly to
our first draft -- and I emphasize the word "draft" since the text on
this page might indeed change in form, grammar, tone and content.

You will notice a calendar describing our process in detail. As you will
note and as discussed on the ALAC and on the ALAC ExCom calls which were
held earlier this week, the ALAC's comment will be submitted well into
the "Reply period" on 4 June 2012.

I kindly remind you that the ALAC is able to submit comments in and out
of comment periods and at its own schedule. It is thanks to this by-law
mandated right, that we will be able to submit our comments, in the
current conditions which are far from optimal. Indeed, our At-Large/ALAC
Review process stipulates a minimum 40 days comment for our membership
spanning all 5 continents to be extended a suitable bottom-up input
process. 24+15 would satisfy this.

As with other comment periods and following-up on our own conversation,
I am able to let you choose which process you would prefer pursuing to
regularise this:

1. please be so kind to receive this message as the ALAC's official
request for a 15 day extension period until 7 June 2012; or alternatively

2. please be so kind to receive this message as advance notification
that the ALAC will be submitting its statement on 4 June 2012 - 11 days
after the opening of the "Reply" period and closing of the "initial
comments" period.

In both cases, this leaves a minimum of 11 days when the ALAC statement
will be published in the public comment space for any other respondents
to be able to comment on our statement.

I look forward to your reply on the matter and trust that the above
offer will confirm our discussions.

Please submit any comments on the workspace using the comments function by
31-May-2012 23:59 UTC.

The Calendar for drafting/updating this statement is:

1st Draft Statement on Wiki page: 24-May-2012
Call for Comments: 24-May-2012 (both to ALAC & to Finance & Budget sub-committee)
Call for comments closing time: 31-May-2012
2nd Draft (final) Statement to be designed: 31-May-2012 until 4-June-2012.
ALAC Vote starts: 5-June-2012
Vote reminder on: 8-June-2012
ALAC Vote ends: 11-June-2012
Statement to be submitted: 4-June-2012

This means that the statement will be submitted during the "reply" period, as discussed on the ALAC and ALAC ExCom calls. ICANN staff in charge of the comment period have been advised accordingly.
