Thank to raise the concern but a third party is also introduce the Reseller
concept (not a registrar, not a customer) ! 

It is really complicated to have the new RAA implemented, understood and
accepted by all those parties involved.

Many complaints stay on ground without any feedback to ICANN or the
Registrar. 

So data are not collected from the Reseller !! And i think it will also part
of our recommendation when and from where it become relevant to collect data
, how often ? how reliable it would be? etc.

 

Maybe ICANN 50 will bring more light and brightness to this dark
environment.

Hi Pam,

Not sure if any data was used, though the Registrar group did warn ICANN and
the LEA's way in advance and frankly it didn't require any rocket science to
predict the current evolving trainwreck. What we have not seen are the
lawsuits from Registrants (no doubt they will come).

- For years people are being instructed to ignore requests from parties that
they have no knowledge about.
- Email providers like gmail, yahoo etc mark these emails as spam.
- Registrants have barely any knowledge about domain names, ICANN,
Registrars are vague terms for Registrants.

When it comes to metrics regarding this issue, the ball is now in the LEA's
corner.
Metric wise we now know that the verification places a huge burden on
registrants and registrars and legit websites are being knocked off the
internet.

What we do not know is how many lives have been saved and how many crimes
have been solved due to the this verification.
As Fadi mentioned in Durban, the LEA's will have to come up with the info
here and we will perhaps see those metrics at ICANN 50.

To me, it raises a number of questions relevant to this WG. For example:



· Was there data used to support those WHOIS related changes reflected in
the 2013 RAA?

· If so, what was the data and the baseline?

· How will effectiveness of changes be measured?

· Who will be collecting the data to measure effectiveness? ICANN?
Registrars? Law enforcement agencies (through the GAC) that advocated for
those changes?



At Singapore meeting, I heard comments about “regulatory impact assessment”
. I do not recall such an assessment done before those changes were
introduced. Anyone?
