 references Recommendation 16 – this creates a distinction b/w CPs who differentiate and those who do not. For those who do choose to differentiate, these CPs would not be subject to 8.8 and 8.9. Additionally, a number of changes were made later in the document.
 Instead of referencing applicable law, it references the lawful basis of the CP. This is important to NCSG b/c there seemed to be a suggestion that if a CP is not required by law to provide a lawful basis, then CP would be obliged to disclose requested data.
 This is problematic b/c it depended on location of CPs and registrants. The lawful basis should be either lawful bases in GDPR or the applicable law of the CP.
