Thanks for the redlined versions and the opportunity to comment further to make sure the draft accurately reflects discussion in the Works Tracks.



I have only two requested additions.   Although there are appropriate references to the Council of Europe’s emphasis on Freedom of Expression, the issue discussed in Work Track 3 about the definition of Community in relation to the Principle of Applicant's Freedom of Expression has not been made clear in the draft of 1.9.1.  The following changes are needed:



1.  in Section f. Deliberations, the following language in red should be added to the current language in black:



"One suggestion is that protecting minority or disadvantaged communities' “identity” and their ability to self-identify, self-associate, and organize in the domain name system is among the goals of the “community” process. The Work Track developed a draft definition that has been discussed with the wider community, but it received minimal support.[1] As a next step towards establishing a definition, the WT will take input from the community to better understand the purpose and goal of having community-based applications in the New gTLD Program.  However, concern was also expressed that any limitation on the existing broad definition of "community", would (1) violate the Principle of Applicant Freedom of Expression and (2) involve ICANN in the evaluation and regulation of content to a degree that exceeds its mission.





Second Item:   ADD TO Question 1.  on which WG is seeking input:

(It is noted that this question has several questions in the text and would be easier to understand if divided.)  Or else make this Question 2:

Do you agree or disagree that the definition of "community"  that applied in the 2012 round should be modified?   (link to definition from the 2012 round)



Separately, I support the change to Deliberations requested by Jamie Baxter in relation to the definition of community.

To be honest, the Annexes which are going to literally copy word from word from the main body of the document (like the preliminary recommendations and the things we are soliciting for public comment), we were not planning to do a draft of for version control reasons.  We didn’t want to have a separate Annex now, then have to fix changes in both versions if there are changes to either of those.



I will discuss with staff today to see what we can do.

Just to clarify what Steve has said below, when he refers to the”remaining elements in the Initial Report” he is referring to purely administrative items such as (a) insertion of the participant list in the applicable Annex, (b) copying the preliminary recommendations and the questions for community input and putting them in the appropriate Annexes, (c) ensuring that the font is the same throughout the report, (d) ensuring consistency with how we refer to the Applicant Guidebook, the 2007 GNSO Final Report, and other terms, etc.



He is not referring to substantive sections that have to be written which would need Working Group review.  Thanks.
