a judicial review standard but without any precedents to follow. “Clearly erroneous” and “abuse of discretion” are judicial standards that have precedent against which the decision can be checked but here we don’t have precedent in these determinations
and we have inconsistent prior decisions. <o:p></o:p></span></p>
