Interesting.  I think a reactive approach is probably the only way to implement such a restriction, as I mentioned in Buenos Aires on a couple of occasions (GNSO Council on Saturday and PPSAI group on Wednesday).  It's definitely great news that they further clarified what is meant by "trading" to exclude those websites which are clearly not accepting or soliciting details directly from consumers.

There’s nobody from Nominet in this group as far as I know, but there are several Nominet members (hi!)

Up until now they’ve been “reactive” i.e. If they get a report from someone or pick up on something in their own systems they’d notify the registrant and the registrar that they were being opted in. I *think* they gave the registrant a couple of days to lodge a challenge, but I could be wrong.
The issue, as I mentioned in my post, is that they were also treating ANY hint of revenue in many cases as equating as “trading”. This of course caused lots of headaches for personal bloggers who might be getting a couple of dollars / euro / pounds per month from Google adsense etc., but weren’t either making their living from their blogs or actually selling anything themselves.

The new policy has only just been announced, so I’d suspect they’ll be providing more details on the operational aspects in due course and before it comes into force in September
