<span style="mso-bookmark:_MailEndCompose">When a contracted party says it cannot comply with its ICANN contract because of local law, should everyone trust what that party says, or should someone verify the facts? The community said “verify.” The Procedure
allows ICANN Org to verify what the local law in question says, allows the parties to work out an acceptable accommodation that is not excessive, and the Procedure provides some transparency.</span><span style="mso-bookmark:_MailEndCompose"><o:p></o:p></span></li><li class="MsoListParagraph" style="color:windowtext;margin-left:0in;mso-list:l1 level1 lfo4">
<span style="mso-bookmark:_MailEndCompose">Uniformity of contracts is a generally desirable thing in this industry. Enforceability of contracts is always necessary.<o:p></o:p></span></li><li class="MsoListParagraph" style="color:windowtext;margin-left:0in;mso-list:l1 level1 lfo4">
<span style="mso-bookmark:_MailEndCompose">The Procedure is failing because a contracted party can only invoke it if the applicable government provides a written statement that the ICANN contract conflicts with the applicable national law, or if the government
states that the contracted party is actually in violation of the law. The government agencies are not forthcoming with such legal analyses right now, and no one wants to be on the receiving end of a “you’re violating the law” letter.
