<b>5 June </b>(ie 2 months ago), I set out my reasoning as follows:<o:p></o:p></span></p>
<p class="MsoCommentText"><span lang="EN-US">I believe this question 2 should be deleted for the following reasons:<o:p></o:p></span></p>
<p class="MsoCommentText"><span lang="EN-US">The language of sentence one is loaded, in that it assumes that there is an unacceptable lack of transparency that needs to be addressed. The language of this first sentence was in the original form of the TMCH
charter questions and the subgroup dealing with these questions revised it for neutrality. I believe that this revision exercise led to the language used at Q 1 above.<o:p></o:p></span></p>
<p class="MsoCommentText"><span lang="EN-US">The second sentence appears to be new, but again somewhat lacks neutrality, implying a lack of necessary information.<o:p></o:p></span></p>
<p class="MsoCommentText"><span lang="EN-US">It would be possible to redraft this Q2 to make it neutral, but in doing so I believe it would essentially duplicate what is being asked in Q1, namely what information is available and where is it?<o:p></o:p></span></p>

<p class="MsoNormal"><span style="font-size:11.0pt;color:#1F497D;mso-fareast-language:EN-US">Granted, it’s not terribly detailed, but I think it’s pretty clear, and we then discussed this first on the call on 21 July and again on the call last week. I don’t
think you had joined us for this part of the discussion on 28 July you were on the 21 July call Kathy. I believe there was a suggestion on the 21 July call that if you wanted to propose a redraft for neutrality we would look at it on the list and on the 28
July call (although since we don’t have transcripts I cannot check my recollection without listening back to the audio and I’m afraid I don’t have time to do that). If you would still like to propose a redraft I imagine we’d be open to considering it when
available, but I’m extremely reluctant to spend any more time discussing the reasoning for the deletion again on today’s call. We must be able to make decisions and move on or we will never get through the questions.<o:p></o:p></span></p>

<p><span lang="EN-US">As raised in the Subteam group last week, I still do not understand why question 2 has been deleted. Question 1 seems to be asking what services are being offered (a quantitative question). Question 2 (former Question 2) seems to be asking
whether the public is in a position to understand the difference between services offered pursuant to ICANN Contract and pursuant to private offerings (a qualitative and transparency question).
<o:p></o:p></span></p>
<p><span lang="EN-US">While I think the placement of the question is probably incorrect - it can certainly be moved later - the underlying issues of transparency, understandability and separation of additional marketplace services -- and the communication means
by which they are shared with the public -- seems very valid. I note that others, from other SGs, agreed in the call last week.
<o:p></o:p></span></p>
<p><span lang="EN-US">May I suggest that former #2 be moved to the end of the current questions to see whether, by the time we reach the end, the issue of what the Public knows about Additional Marketplace RPMs has been addressed. If not, this question, in
some form, should remain in.<o:p></o:p></span></p>
