Consolidation SubTeam
As I have been re-reviewing the first public comment input, I have noticed that the summary spreadsheet is not complete.  A couple of comments are missing: IPC (not listed) and Fletcher Hildreth/Kathy Kleiman (listed on the sheet but the comments are not included).  For some of the others, the text on the spreadsheet is a pretty high-level summary.  You may therefore want to look to the original comments in full.  These are compiled and listed on the front page of the IRP-IOT workspace, but I am also attaching a downloaded copy since it is easier to identify numbered pages.  The comments which seem to touch on consolidation, intervention and joinder/amicus are as follows:

dotMusic – page 11 – decisions should be made by the panel, not PO
IPC – page 24 – decisions should be made by panel, not PO.  Participants in underlying proceedings should be able to petition to join
NCSG – page 32 – similar comments to Fletcher
Fletcher – page 47  - extensive comments regarding right to participate by those a party to underlying proceedings, and, where a policy is being challenged, by the SO responsible for the policy, together with SGs who participated and PDP chairs.
RySG – page 80 – for panel to decide whether such applications should be dealt with by panel or PO

Some of these points do seem to have been adopted into the Interim Rules.

Action items

1.      Sub-group members to review History of Amicus document (IOT-HistoryofAmicus-20210124-V1.0) and the results of the first public consultation by the IOT (CCWG-Accountability-WS2-IRPIOT-PublicConsultation1-Responses-AnalysisV1.0BT) both of which were distributed with the agenda for the last meeting. The objective of this is to prepare to discuss at the next meeting if the focus of this sub-group is in line with the expectations and requirements.

2.      SP will revise the mark-up of the Rule 7 document for the next meeting.
Agenda:

1.      Review selection of sub-group Chair/Rapporteur.

2.      Review of agenda.

3.      Review Action Items

4.      Review the questions raised in the email by SP titled Input sought by Consolidation Subteam (included in the material for the previous meeting as IOT-ConsolidationSG-email-SP-20210301, and reproduced below), to ensure that all required elements are part of the sub-group’s objectives.

Questions:

•       What is the intent of this section and, in reviewing it, what is the problem we are trying to fix

•       What input was received in the public comment

•       What were the previous discussions of IOT group

•       Does the proposed amended language address the “problem” and does it cause future issues for any other group

5.      Next meetings – Tuesday, December 7, 17:00 UTC.
