For the second agenda item 3, please see the attached summary of our agreement on the Fixed Additional Time, edited to reflect, as discussed last time, that the time allowed is the longer of the remaining time to run to bring an IRP or the FAT.

I also included something that I think we did have in an earlier iteration of the proposal – to reflect that not every RFR does actually lead to a minuted Board decision.  If the BAMC summarily dismisses the case this seems to be the end of the matter.  This would generally happen within a short period of time, and so, generally, I think the complainant would not be out of time to file under the IRP rules, but since there isn’t a fixed time-period for BAMC dismissal it would seem appropriate that we consider this and address this scenario (or knowingly exclude it).
