Dear Law Enforcement Subgroup,

Attached to this email you will find the revised survey for your review. Edits you requested on your call #3 were implemented. In addition, ICANN org made edits to the questionnaire structure, in consultation with Cathrin, to improve user experience. Cathrin also suggested improvements to some of the questions. All questions are required fields with the exception of questions 10, 23, and 37.

As you know, a number of questions are conditioned on responses provided to prior questions. To avoid confusion of any observer or community member following archives of your mailing-list, I will be sending a URL link to the survey shortly to your individual email addresses. Using the link to navigate through the surveu will help improve your experience reviewing it (especially given the conditioned questions). Any comments/input you may have should be directed to rds-whois2-lawenforcement at icann.org<mailto:rds-whois2-lawenforcement at icann.org> for all to see and react to.

In addition, see below a revised draft (reviewed/edited by Cathrin) for the notification to your LE contacts:
As you may be aware, the Domain Name WHOIS protocol allows users, including law enforcement, to look up information on who is behind a domain (web site address). The functioning of the WHOIS is subject to regular reviews. As part of one such review, the ICANN RDS-WHOIS2 review team is conducting a survey examining current and past uses of WHOIS by law enforcement, to inform its assessment of whether WHOIS meets the needs of law enforcement. We would be grateful if you could share your experience with us if you use WHOIS in the performance of your duties, or have used WHOIS in the performance of your duties. The survey should take around 10-15 minutes to complete.
If you are willing to contribute, please respond to this email with "agree" in the subject line to signal your agreement to participate in the survey, cc'ing jean-baptiste.deroulez at icann.org<mailto:jean-baptiste.deroulez at icann.org> (in copy to this email), and we will share the link to the survey with you.
The survey is conducted in accordance with the ICANN Privacy Policy https://www.icann.org/privacy/policy [icann.org]<https://urldefense.proofpoint.com/v2/url?u=https-3A__www.icann.org_privacy_policy&d=DwMGaQ&c=FmY1u3PJp6wrcrwll3mSVzgfkbPSS6sJms7xcl4I5cM&r=hgoi2V8bykqXjZC9kZZRTDSEJ4lQIyKh6k8Q-TUv6Ks&m=HWZbdi8QsErwDjmgucCC3-Lq_jBoGrUTdwLSRCzVWy0&s=7IQSIWHHbwxSE0mGhzjVw2itGAjs7tt2qgDVAu4RymU&e=> and website Terms of Service https://www.icann.org/privacy/tos [icann.org]<https://urldefense.proofpoint.com/v2/url?u=https-3A__www.icann.org_privacy_tos&d=DwMGaQ&c=FmY1u3PJp6wrcrwll3mSVzgfkbPSS6sJms7xcl4I5cM&r=hgoi2V8bykqXjZC9kZZRTDSEJ4lQIyKh6k8Q-TUv6Ks&m=HWZbdi8QsErwDjmgucCC3-Lq_jBoGrUTdwLSRCzVWy0&s=469f7SaotsAqIflcCkWPNySmgMikldRw7tpPAvL3-gM&e=>.

We are waiting to hear back from ICANN legal on whether personal email addresses (vs. agency addressed) are acceptable.

Reminder:

  * These materials are still drafts. Please do not share with your contacts yet.
  * Input is needed by close of business – Friday, 13 July (as defined on call #3).

Thank you,
Kind regards
Alice
