We have not achieved consensus on the SLA text in this section.
I put my comments into the google doc last nite.

My biggest problem surrounds the assumption that we can
trust private, commercial data as evidence that should 
cause ICANN to assume a registrar/registry is "guilty until
proven innocent" and take punitive action if registrars 
can't prove their own innocence.  

We have something buried 3 pages later about recommending that

	ICANN Org should ensure it structures its agreements with 
	any data feeds providers to allow for further sharing of the
	data with independent researchers for reproducibility and
	peer-reviewed scientific research, at no additional cost. All
	data-sharing contract terms should be published on 
	the ICANN web site. 

This latter recommendation will have to be : (1) strengthened
significantly, such that independent third parties can verify
or refute the findings of the commercial providers, at icann's
expense; and (2) implemented prerequsite to any use of this
data as evidence in a 'registrar takedown', and (3) result in
something so different from the current DAAR model as to be
confusing to even call it DAAR.

The current text recommends that ICANN toss out any
concept of due process.    It's a non-starter, afaict.
Even regulators wouldn't do that.  Indeed, regulators
would put a stop to it.
