When a legal body evaluates possibility to 
register a domain in ccTLD, they have to research policies and rules of that particular ccTLD.

Thus in both choices (ccTLD of that location, or some TLD) they follow policies of that particular registry.
(and consequences for the choice of the name is fully on them ).
