Carrie,

First, this seems like a non sequitur to me.  Can you explain how this is
relevant to the work of WP1?  I've reviewed the agenda materials at the
beginning of this email thread and I don't see the connection.

Second, you should be aware that this is not entirely a hypothetical
scenario.  It is a hypothetical variation on actual events.

Third, if two parties (regardless of who they are) apply for the same gTLD,
the AGB (the new gTLD Applicant Guidebook, in case you are not familiar
with it) details how such "contention sets" may be resolved.  So, this is
also not really a hypothetical situation.  As such, there is no need to
speculate or hypothesize the ways in which a contention set could be
resolved, and what if any variable could serve to elevate one application
above another.

Fourth, I would disagree emphatically with your assumption that "the
Amazon" (which is a river, by the way, and not any type of geopolitical
entity) has some sort of legally cognizable claim to ".Amazon" and further,
that that claim (assuming purely for the sake of argument that it has a
legal basis) is somehow superior to the intellectual property rights (which
are absolutely a legally cognizable claim) of Amazon the company.  I
recognize that there are those who disagree and that this is indeed a live
discussion elsewhere in ICANN.

For all of the reasons above, I don't think it's appropriate to raise this
question in this forum.  We have enough relevant matters to discuss.
