Estimada Jacqueline,
Lamento la demora. Ello se debe a que trato de escribir en EspaÃol y en
InglÃs para que las dos listas puedan entender claramente. Esto me toma
varias horas.
La norma de la regla 12.2 seÃala lo siguiente:
12.2 En conformidad con lo establecido en las Reglas 6.2 y 16, las
resoluciones se decidirÃn por mayorÃa de las Estructuras de Alcance
presentes que voten; para los fines de estas Reglas, la expresiÃn
"Estructuras de Alcance presentes que voten" se referirà a las
Estructuras de Alcance que emitan un voto afirmativo o negativo. A las
Estructuras de Alcance que se abstengan de votar, se les considerarÃ
como si no hubieran votado.
La norma regula tres situaciones:
1.- Que una Estructura de Alcance emita un voto positivo
2.- Que una Estructura de Alcance emita un voto negativo
3.- Que una Estructura de Alcance se abstenga de votar.
Un ejemplo que cubre estas tres situaciones serÃa el siguiente:
ÂEsta Ud. de acuerdo con que XXXX sea presidente?
1.- SI
2.- NO
Si una Estructura de Alcance vota SI, està emitiendo un voto afirmativo.
Si la Estructura de Alcance vota NO està emitiendo un voto negativo.
Si la Estructura de Alcance no hace nada, se està absteniendo de votar.
Aquà se cumplen perfectamente los supuestos de la norma.
Sin embargo, en la situaciÃn planteada de la elecciÃn de ALAC Member la
situaciÃn es distinta y la norma no calza correctamente.
La pregunta que se hizo fue la siguiente:
*PREGUNTA*: ÂA quien elige usted para ser representante del LACRALO ante
el ALAC por el periodo de 2 aÃos comenzando en la reunion de ICANN en
Octubre del 2015? Por favor elija un candidato de la lista abajo (en
orden alfabÃtico) o abstÃngase:
* Harold Arcos
* Juan Manuel Rojas
* AbstenciÃn
El voto entregado en favor de Harold Arcos o Juan Manuel Rojas es un
voto afirmativo.
El voto por la opciÃn abstenciÃn es un voto negativo.
Quienes no hicieron nada, se abstuvieron de votar.
Por eso, los resultados se entregaron en forma correcta.

debe ser explicado de manera que no haya confusiÃn.
Teniendo en cuenta la intenciÃn muy clara de la regla, es obvio que como una
consecuencia de cualquier movimiento (incluyendo propuestas de las
elecciones) no se puede pasar
si el voto ponderado por los representantes de ELA que se abstienen o no
voten es
mÃs de 50%.
Por lo tanto, creo que la mociÃn para elegir a un representante ALAC ha
fallado.
Espero que los prÃximos pasos, y espero que estos, a diferencia de la
anterior, se adherirà a la letra y el espÃritu del Reglamento de la
LACRALO en su redacciÃn y debidamente aprobado.

I don't know when the change was made, but it is counter to the

been double checked!
