Welcome by Chair Stephen Deerhake to this first meeting of the year. Happy New Year to all.

2.                   Public Comment submissions received

a.                  Review of submissions received

Public comments closed yesterday, 24 January. Bernie lists the comments and a proposed analysis.

  *   Only “real” submission by ALAC. Support for the recommendations. 1 page of ALAC process. Analysis proposed. Comments mostly beyond scope of PDP.

b.      Staff summary

No needs to adjust the initial report based on the comments received

3.                   Next steps in process:  Final report, submission to Council, ccNSO decision making

Bart: all next steps were summarised, up to submitting a final report to the Board.

  *   Summary public comment by 7 Feb (staff)
  *   Finalise report by 1 March (WG)
  *   Submit final report to Council by 2 March (Chair ccPDP3-RM). 16 March Council meeting
  *   Self evaluation (WG) in Cancun? Based on recent council workshop recommendations.

Next steps for Council?

  *   Council to invite GAC to provide opinion or advice by 9 March (Chair)
  *   Council deliberations and decision by 16 March (Council)
  *   Members Report (i.e. final report, council decision, copy of minutes) (Issue manager, approved by Council)
  *   Circulate decision

Member’s vote

  *   Starting 18 April. Open at least 3 weeks. End 9 May
  *   Advantage: use the icann meeting that it is forthcoming
  *   87 members need to vote. Quorum requirement.
  *   Assuming the vote is valid, the Board report needs to be created. Needs to be adopted by Council. Then the Board Report can be submitted to the Board. Earliest in June 2023. We could use ICANN77 to inform the Board.

Final steps before Board considers the policy (as per the bylaws)

  *   Chair Board will request a GAC opinion.
  *   Public comment, at least 40 days

Stephen: comment regarding potential delay
Bart: everybody learned their lessons. Processes need to be followed. Communication around what is happening is the only way forward. All are keen to make this happen.

Irina: GAC opinion twice?
Bart: the way processes evolve. Original one is from 2003 when ccNSO was established. Section 3.6 (ii) is a different one. One is initiated by ccNSO, and one by the Board.
Irina: could they ask for adjustments in the policy?
Bart: in annex B it is open what to do with the opinion or advice. But the GAC opinion needs to be asked. Just after the public comment was started, there was a webinar. GAC was invited to attend, and they asked questions. It is good to record this in the final report. There was one clear message: this policy will not change any existing policy. It builds on it. Important to point this out in the introduction.

Bart: voting is open long enough. Also, sufficient heads up that the vote is coming up.

Bart points out staff’s unavailability during the 6 Feb week
Proposal to meet on 1 Feb at 19 UTC
2nd reading 2 weeks later (15 Feb), and another meeting on 1 March
