BC Comment on Proposed Renewal of the .AERO Registry Agreement
This document is the response of the ICANN Business Constituency (BC), from the perspective of business users and registrants, as defined in our Charter: The mission of the Business Constituency is to ensure that ICANN policy positions are consistent with the development of an Internet that promotes end-user confidence because it is a safe place to conduct business; Is competitive in the supply of registry and registrar and related services; and is technically stable, secure and reliable.


This comment is in response to the “Proposed Renewal of the .AERO Registry Agreement” posted for comment on July 6, 2021 (https://www.icann.org/public-comments/proposed-renewal-aero-agreement-2021-07-06-en).


The BC supports the proposed renewal of the .AERO Registry Agreement pursuant to the proposed Sponsored Registry Agreement (the “Registry Agreement”), as proposed by ICANN Org and the Sponsor, SITA Information Networking Computing USA, Inc. (https://www.icann.org/en/system/files/files/proposed-aero-agreement-clean-06jul21-en.pdf).

The BC recognizes the importance of maintaining the TLD Sponsor’s role, obligations, and commitments to the sponsored TLD Community and therefore appreciates that the .AERO Registry will remain a sponsored registry pursuant to the Community Registration Policies set out in Specification 12 to the Registry Agreement, which inter alia includes the existing .AERO Charter.

The BC also recognizes the importance of including in the renewed and updated Registry Agreement, provisions which exist in the base registry agreement, inter alia; Specification 4 (Registration Data Access Protocol)., Specification 7 (Minimum Requirements for Rights Protection Mechanisms), and Specification 9 (the Registry Operator Code of Conduct), Specification 11 (Public Interest Commitments),

The BC also recognizes the importance of including in the Registry Agreement, certain provisions which differ from the base registry agreement, such as the Emergency Transition provision, Registry Interoperability and Continuity, Pass Through Fees related to the Trademark Clearinghouse, and Fees Paid to ICANN. In reviewing these new provisions, they appear appropriate to include given that the registry has operated continuously since 2001 and since these provisions are consistent with other legacy TLDs.
