As a reminder, one of the Action items from the GNSO Council call on the 18 May 2017 was that Thomas Rickert as a follow up to the update he provided on the call, provide the Council with an additional update on the WS2 Jurisdiction sub team’s work to date.

Sorry for the delay.

The current status of the Jurisdiction sub-group is as follows:


  *   Currently working on completing the analysis of ICANN's past litigations with the sub-group - about 50% completed and pushing to complete by ICANN 59.
  *   Currently working on analyzing responses to the Jurisdiction questionnaire - some in the sub-group was disappointed that there were only about 20 responses. Most responses did not find any issues with ICANN's jurisdiction of incorporation and did not provide any documentation relative to this. However a number brought up issues around OFAC, governments being asked to sign a contract with ICANN for a TLD or issues around certain names such as WINE. Again the sub-group is trying to complete this by ICANN 59.
  *   The sub-group has received a response from ICANN legal regarding an initial list of questions with respect to jurisdiction and is currently awaiting a response to questions regarding the choice of law vs the Registry and Registrar agreements.
  *   The work plan is focused on completing the above analyses and then returning to the work of identifying issues, if any, and proposing solutions to any issues identified.
