After discussions in the BC we would like to add the following language to the response to the GAC advice.

"The GNSO Council agrees with the GAC that the continued and lawful availability of WHOIS/RDS data for consumer protection, intellectual property rights protection and law enforcement activities is a vital public concern and that ICANN should strive to explore all possible mechanisms under the GDPR to ensure that this data remains available for legitimate activities that protect the public and promote a safe, secure, and trustworthy online environment.  Especially, when the WHOIS/RDS data is associated with a domain name used for commercial activity."

I have reviewed the document for a final sanity check and made some very minor typographical edits for consistency in the attached. The only substantive edits are that we hadn't filled out columns 3 and 4 (does the advice concern GNSO remit and is it subject to existing work or recommendations) for a few items. I have inserted text here but would appreciate the drafting team casting eyes over, as it may well be that there was a reason for not responding to these, and I missed that.

Finally, a plea that everyone socialise this Response this week within SGs and Cs and raise any concerns or proposed edits prior to Thursday's Council meeting. Our response is only effective if it reaches the Board in a timely manner as the Board considers the relevant GAC advice. For this to occur, we need a Response that we can agree on and approve in Thursday's meeting. If any SG/C has concerns, I ask that you please raise these on the list as soon as possible.

Many thanks to the drafting team and to Donna for shepherding this effort from Council leadership. It's brilliant to have such efficient production of the response, even with the interruption of North American Thanksgiving holidays.
