Theo,

This issue is definitely second to the contract amendments, but still 
something worth exploring in our attempts to stop malicious action while 
preserving a good experience for the legitimate user.

Bonus trivia: The Conficker case was the first time I became aware of 
ICANN, and began studying it as a result. :)
