"Domain names are generally regarded as intangible personal property".

Is this true globally ?

A quick working definition from my notes:

Intangible property is property that does not derive its value from 
physical attributes.
Good examples: Patents, software, trademarks and license.

A couple of questions:

What are the ICANN specified criteria for making the WHOIS Data 
non-public by small, medium
and large categories of the domain registrars?

How is the Legitimacy of the request for non-public registration data 
established for
small, medium and large categories of the domain registrars?
