[CPWG] GNSO Transfer Policy Review PDP: Discussion to the Losing FOA

Dear all,

In preparation to the CPWG call on Nov. 30, 2022, please get familiar to the Strawman proposal to the GNSO TPR Initial recommendation 2<https://docs.google.com/document/d/1e8iG6FmRD0M5VlMUrmIedPw3burqfxLXQrkubxDJ3oQ/edit> based on the input from the public comment for the Initial Report Phase 1(a).

At-Large responded to the public comment for the GNSO TPR Initial Report Phase 1(a) that the Losing FOA (Form of Authorization) can be removed/eliminated.

The PDP Working Group has discussed the Losing FOA based on the received public comments and concluded to revert the initial recommendation by adding a similar process as todays transfer policy requirement.

In short, the Strawman recommendation will add a period of 5 days before the TAC (Transfer Authorization Code) will be set by the sponsoring registrar for the domain name to be transferred.

Recommendation 2: The working group did not reach agreement to eliminate or substantially change the Obligations of the Registrar of Record described in Section I.A.3.1 - I.A.3.6 of the Transfer Policy. Therefore, the working group anticipates that these requirements will largely remain in place. The working group recommends the following minor modifications:

  *   The term [“Transfer Confirmation”] must be used in place of “Standardized Form of Authorization (FOA).”
  *   [The [Transfer Confirmation] must include the Gaining Registrar’s IANA ID]
  *   [The [Transfer Confirmation] must include both an opportunity for the RNH to proactively accept the transfer AND an option to cancel the transfer]
  *   [The [Transfer Confirmation] must be provided in English and the language of the registration agreement and may also be provided in other languages]

If At-Large is not in favor of the Strawman proposal, the WG Chair has asked the Working Group members to give their position before the updated recommendations are finalized.

It is allocated a 15 minute discussion for this at the CPWG call on Nov 30, 2022 at 19:00 UTC.
