I agree with that Andrew once we have the SLEs defined and in the contract.  But they first need to be defined and it seems to me that they would need to be defined before the contract could be developed and executed.

You have an oversight function and it's written into the contract.  If the contractual terms aren't followed, then the contract is terminated by the oversight body.  This doesn't seem to me like the sort of thing that needs some other kind of lever.
