Volker, case 2 *is* a potential use case. You may not think it likely that a user will be able to make a sufficiently good case, and perhaps you are correct. Or not. We explicitly say that this is not one that could likely be handled in an automated way.

Perhaps Case 1 SHOULD be LEA, but in reality, the effort is shared among many players and consumer-oriented entities are among them.
