[Gnso-igo-ingo-crp] Reminder: Co-Chairs’ Summary, Statement, and Proposed Next Steps” (January 31, 2018),

Just a reminder, that in the “Co-Chairs’ Summary, Statement, and Proposed Next Steps” (January 31, 2018),based on the second call between Mr Kirikos and us co-chairs, on Mr Kirikos’ appeal under Section 3.7, Phil and I suggested some steps to move forward:

a) Determine whether WG members wish to hold another call to attempt to further clarify and consolidate the existing six options for resolution of Recommendation Three.

b) Immediately after such call (or just immediately, if it is not supported) prepare and distribute a public and transparent poll of WG members to support their primary choice among Recommendation Three options; and their support/opposition and additional comments for the remaining options, as well as the other three Recommendations, with poll results to be tabulated and distributed as soon as feasible during February. At that time the co-chairs will “make an evaluation of the [consensus level]designation and publish it for the group to review” to initiate the consensus call process through the method recommended in Section 3.6 of the Guidelines [<https://gnso.icann.org/en/council/annex-1-gnso-wg-guidelines-01sep16-en.pdf>].

c) Resume WG calls to discuss the poll results, co-chairs’ estimated designations, and move toward final consensus positions while preparing for the facilitated session.

d) Hold a facilitated WG session at ICANN 61.

That conclusion and suggestion to move forward was howeverstrongly opposed by Mr Kirikos, who stated that:

“A poll (non-anonymous, and agreed to by all before it got sent out,unlike the last one) was supposed to be a "last resort", *IF* thefacilitated process to reach consensus failed. In other words,if itwas ever to take place, it would only be *after* the facilitatedprocess…I don't agree with the newly proposed process at all, as itdoesn't reflect what was agreed on January 18, 2018. If the co-chairsare reneging on that agreement, I intend to invoke Section 3.7 again.” (February 1, 2018).
