Staff thought it may be helpful to follow up on the last topic of discussion from the Working Group call of earlier today by providing some additional background information. We note that Greg supports adding the name “Red Star of David” to the list in our Final Report, Stephane’s message (below) mentions the “Red Star of David in Israel” as well, and no objections were raised to the suggestion to include the name “Red Star of David” on the final list. 

 

As highlighted on the call, the name “Red Star of David” is currently on the list of Red Cross names that were reserved on an interim basis, along with “Magen David Adom”, “Lion et Soleil Rouges” and the acronyms of the Red Cross movement. Also as noted on the call, should the finite list this Working Group submits be approved and implemented, these terms – as well as the list of National Society names that were placed under interim reservation at the time -  will no longer be reserved as there will no longer be an interim reserved list (except for the acronyms). For “Magen David Adom”, this is a name that has been requested by the Israeli national society (see Count/Row #102 in the XLS spreadsheet from Berry), so it is already on our final list. For “Lion et Soleil Rouges”, the singular term “Lion et Soleil Rouge” is the French translation of the name “Red Lion & Sun” – so, along with the names “Red Cross”, “Red Crystal” and “Red Crescent”, it is already reserved (in all 6 official languages of the United Nations) under the Consensus Policy that went into effect yesterday. This therefore leaves the name “Red Star of David” (from that interim reserved list) as the sole term to be determined.

 

Staff research indicates that the names and acronyms (including “Red Star of David”) that appear on the interim reserved list can be traced initially to a list sent by the GAC to the GNSO in late 2011 which the GNSO’s Red Cross/International Olympic Committee Drafting Team considered in developing its recommendations preceding the original IGO-INGO PDP. At the top level, the name “Red Star of David” is also already protected for the 2012 New gTLD Program round, as is “Magen David Adom” (see Section 2.2.1.2.3 of the Applicant Guidebook). 

 

We hope this background information is helpful as the Working Group finalizes the list and recommendations in the Final Report (just circulated by Berry to the mailing list).

As agreed on the call, I am sharing herewith some suggestions 

-        To Heather’s earlier text of reply:   

The WG respects the general principle of protecting the freedom of speech, and has given this serious consideration in the context of the finite and very limited nature of the list of protected names, being names corresponding to the official names of National Red Cross and Red Crescent Societies. This list was compiled by the International Red Cross and Red Crescent organisations and carefully reviewed by the WG and relevant supporting experts. The WG considers it unfortunate that these comments were not raised during the WG’s deliberations, and further that they did not take into account the extensive discussions that the reconvened WG has had to specifically ensure the legitimate basis for and finite nature of the list of protected names. On reflection the WG is confident that free speech considerations, whilst not raised during the reconvened WG’s discussions, have been adequately taken into account.

The Reconvened Working Group suggests that the International Committee of the Red Cross and the International Federation of Red Cross and Red Crescent Societies jointly notify the GAC, the GNSO and the ICANN Org of the process of formation and of recognition of a new National Society as a component of the International Red Cross and Red Crescent Movement, and thus, so as to ensure that the relevant identifiers of the said Society in formation benefit from advanced protection and to thereby minimize the risk of front-running registration of such identifiers.  The Reconvened WG understands and acknowledges, however, that such a step is outside of ICANN’s remit and the scope of this policy process; as such, its adoption is purely dependent on the relevant internal processes of the International Red Cross and Red Crescent Movement. 

It would indeed be valuable to add the names "Red Star of David" and "Red Star of David in Israel" (in English) to the table of identifiers and names for reservation - thus as the translation into English of the official and commonly used names the National Society of the Magen David Adom in Israel. 

We look forward to receiving the final version of the Motion and of its attachments for submission to the GNSO Council - for a final read.

Following on Berry’s note below and the agenda for the Working Group call tomorrow, attached for your information is a draft motion for the GNSO Council to approve the final recommendations from this group following your review of the three public comments received (and assuming the group agrees on the final recommendations tomorrow). As is customary, staff anticipates that Heather (as the Council liaison to this Reconvened Working Group) will propose the motion to the Council before the deadline for the next Council meeting, i.e. Monday 6 August. Please note that as the proposer of the motion, Heather may wish to edit or amend the text of the motion prior to submission.
