Dear Work Track members,

Staff had an action item from the last IGO Work Track call of 24 May, to prepare and circulate the relevant links and summary of some existing materials that the IGO-INGO Access to Curative Rights PDP Working Group had considered; namely, its discussion with Nominet’s General Counsel concerning Nominet’s dispute resolution policy in December 2017, the report on jurisdictional immunity prepared by commissioned legal expert Professor Edward Swaine in June 2016, and a paper on elements to consider for an arbitration paper that had been prepared by the WIPO Secretariat in relation to country names in November 2003.

Staff has compiled the reference materials and prepared the following summary, which is attached to this email. We hope the information is useful and reflects the Work Track’s request from your last meeting.

Best regards,
Steve, Berry & Mary
