Hi Berry, all,

As a first quick pass, below are a few suggested amendments to the final report.

The main point is to make clearer throughout that arbitration is only available to a registrant following court proceedings if the court declines to hear the merits of the case due to the IGO’s P&Is – and not, for instance, because the case was summarily dismissed or because registrant filed in the wrong jurisdiction/made a procedural error resulting in the court dismissing the case.

Lines 44 and 45: delete ‘and where the court declines to hear the merits of the registrant’s case’
Line 251: after ‘case’, add ‘on the basis of IGO privileges and immunities’
Line 301: after ‘case’, add ‘on the basis of IGO privileges and immunities’
Line 308: after ‘case’, add ‘on the basis of IGO privileges and immunities’
Line 338: after ‘case’, add ‘on the basis of IGO privileges and immunities’
Line 569: error with footnote
Line 576: after ‘case’, add ‘on the basis of IGO privileges and immunities’
Line 626: delete ‘even’
Line 627: after ‘case’, add ‘on the basis of IGO privileges and immunities’
Lines 313, 355: delete ‘competent’ (the tribunal is necessarily competent if constituted to hear the case)

Just a reminder of the process we are using to wordsmith the report (as opposed to substantive issues).

1) Please note your name and the group you represent in the “Group Submitting” column.
2) For the “Line Number(s)” column, denote the line numbers from the clean version of the PDF of the Final Report for which you want to suggest a revision. For sentences or paragraphs, it will be helpful to list the full range of line numbers.
3) In the last column, “Proposed Revision”, please add your suggested edit or correction that you feel enhances or makes more clear the intent of the recommendation or supporting text without changing the intent. It should not be necessary to quote the text from the report. In more complex proposals, a rationale statement should be included to help inform the EPDP on why the edit should be made.

Whilst it would be great if we could have the suggested edits by 23.59 UTC today I acknowledge that some of you may not be able to respond by then. We will endeavour to add edits that come in over the weekend so that the document before us on Monday is as up to date as possible.

HOWEVER PLEASE NOTE: we all NOT be taking time on Monday during our zoom meeting to deal with word-smithing edits. There will be an opportunity next week after our meeting to run through a final time using the form linked above.
