For most of those obligations there are no graded sanctions or penalties, which means that if a registry is in violation of any obligation, receives the 1st, 2nd and 3rd notices, is then issued a notice of breach and still doesn't cure, it could go to termination without any penalties in between. However, some of the agreements include an appendix specific to SLAs (service level agreements). These SLAs provide that when the registry operators fail to comply with their Technical and Performance Specifications, they have to apply credits to the registrars' fees, depending on the specification that was not met and the impact. The SLAs provide tables that explain what credits apply for each type of specification. See one as an example: http://www.icann.org/en/about/agreements/registries/info/appendix-10-08dec06 -en.htm . These credits, although not technically penalties, do affect the registries negatively. Best wishes, Lars -------------- next part -------------- An HTML attachment was scrubbed... Bladel:Dialing in.... Julia Charvolen:Sound is not low, let me see if something can be done with the operator Simonetta Batteiger:it was a little better now... Julia Charvolen:@ Simonetta - Is sound better now? Simonetta Batteiger:yes Julia Charvolen:Thank you Rob Golding (Astutium-1471):I completed the poll :) Kristine Dorrain:Sorry for the delay. I"m here, with no mic yet...I may try the audio bridge. Julia Charvolen:Thank you Kristine, please let me know if I can help Rob Golding (Astutium-1471):How much more detail do we think woudl be useful in the TDRP reports ? If they're by registrar and say how many started and how many resolved (and therefore how many outstanding) , what else is needed ? Lars Hoffmann:https://www.adndrc.org/tdrp/tdrphk_decisions.html Kristine Dorrain:It's pretty easy for NAF to publish TDRP decisions. I missed the last meeting...are you looking for some sort of integration between Registry TDRP decisions and, for instance, TDRP Provider Appeals? Kristine Dorrain:That was us...we don't publish because we aren't directed to. Kristine Dorrain:There is no underlying reason why not to, other than we were awaiting the affirmative direction to do so. Kristine Dorrain:Sorry for not raising my hand, I'm trying to get my mic to work...if you want me to call in on the phone, I can. Paul Diaz (Public Interest Registry):Thanks, Mikey. Based on the provided link, it's clear that the data is pretty straight-forward. Including PDFs with the actual decisionmaking gets at the "content" concern I had, i.e. if people want to drill down they can, but the statistics can remain clean Julia Charvolen:Kevin Erdman joined the meeting Rob Golding (Astutium-1471):26th I'mon holiday, so wont be able to make the call, although will probably have laptop with me to access the adobe -------------- next part -------------- An HTML attachment was scrubbed... Julia Charvolen:Rob Golding joined the meeting Bob Mountain:Kristine your volume is coming though very loud Kristine Dorrain:thanks Bob. This VoIP is new to me. I've reduced the volume, hopefully that reduces the volume to my mic too. Kristine Dorrain:I'm not disagreeing about court, Volker. I think there is a point in which it gets too complex for a simple dispute resolution policy. I wonder if jurisdiction has been dealt with, when there are "multiple hops"... Kristine Dorrain:the benefit of a dispute resolution policy is that some of those jurisdictional issues get dealt with... Volker Greimann:I am not saying we should gert rid of the TDRP Bartlett Morgan:sorry, I got cut off just now Kristine Dorrain:agree with Barbara...there is currently a six month statute of limitations...I wouldn't want to extend it any longer, but perhaps Kristine Dorrain:agree with Barbara...there is currently a six month statute of limitations...I wouldn't want to extend it any longer, but perhaps I didn't catch the reason for extending it Mike O'Connor:ah. good point Mike O'Connor:i'm not keen on opening TDRP directly to registrants Mike O'Connor:too much room for abuse Kristine Dorrain:What sorts of abuse do you see, Mikey? I'd love to explore this... Kristine Dorrain:PErhaps next call? Avri Doria:Dreamer Mike O'Connor:argh! just cut out Kevin Erdman:yes, good summary! Kevin Erdman:Step 1--some clearance at Registry, Step 2--some interaction with ICANN legal Kristine Dorrain:And I know ICANN Legal/Compliance won't want to "hands" on each of these, so I think we would assume that this will end up being a part of their ticketing system Kristine Dorrain:yes..Registrar first... Kristine Dorrain:Good point, Barbara... Berry Cobb:Curious, what is typical quantity that Registries receive TDRP? Volker:we found that to be rather on the low end Volker:but it will likely increase if the process is opened up to registrants Kristine Dorrain:And the non-.com registries have handfuls... Bob Mountain:THat sounds right, it was very low. Volker:sure Berry Cobb:You won! :-( Chris Chaplow:leaving desk for a moment Berry Cobb:Charter Question D could be address by output of Charter Question C.
