While discussing the draft report on auctions during last week’s plenary, Jeff asked that the person who forwarded an example of irregularities with auctions to the WT leadership and staff, send that information to the entire list.  Per Jeff’s request, I am now doing that.

I forwarded an article co-authored Paul Livesay formerly from Verisign, and Jose Ignacio Rasco, from Nu Dotco, LLC    http://www.circleid.com/posts/20161107_afilias_cynical_attempt_to_secure_a_windfall_at_community_expense/

What caught my eye was this paragraph.

“The Applicant Guidebook prohibits all applicants within a contention set from discussing "bidding strategies" in advance of an auction — termed the Blackout Period. Violation of the Blackout Period is a "serious violation" of ICANN's rules under the Bidder Agreement, and may result in forfeiture of an applicant's application. Afilias committed such a violation, and should be disqualified. On July 22, just four days before the public ICANN auction for .web, Afilias contacted NDC again to try to negotiate a private auction if ICANN would delay the public auction. Afilias knew the Blackout Period was in effect, but nonetheless violated it in an attempt to persuade NDC to participate in a private auction that would net Afilias millions of dollars even if it lost.”

While this group is a forward looking group and has no remit over this particular auction, these pieces do inform the WG that auctions may not have gone as smoothly as people think and we do need to take a hard look at the auction process going forward.
