Hi Kathy,

you raise a valid point here, however takedown needs to be one of the 
tools available to privacy or proxy service providers as they usually 
have no other legal protection against claims brought against them for 
custome complaints. They need to be able to completely disavow 
themselves of a domain name in certain cases to avoid liability.
On the other hand, legitimate rights to continued privacy in other cases 
needs to be considered as well.

So I agree with Kathy that simply removing this part of the discussion 
is not helpful. This needs to be discussed.
