It is inconsistent to say you shouldn't collect registrant name at all b/c it isn’t needed for the purpose of RDS as you've defined it, then say its ok to share registrant name subject to certain laws/procedures.  I believe a primary purpose of the RDS is to build trust in the network (hence need for some transparency) and for communication with a registrant, and the purpose you have espoused is too narrow.   I hope we can move past extremes and find common sense policies that reasonably take the various interests and existing law into account.

No, we are fine with registrants making some information available through WHOIS/RDS subject to data protection law (eg. informed consent, etc).  But we don't think that a starting point for the design of the RDS has to take the requirements of anti-abuse specialists or reputation systems as an essential element.
