Below are the action items and notes staff captured from the RPM Data Sub Team meeting on 06 April 2018. Action Items

  1.  Staff to develop a summary document about the Additional Marketplace RPMs that includes: 1) questions to Donuts during the ICANN61 session and responses received, 2) any action items related to the questions, 3) initial research result conducted by staff.
  2.  Staff to check Deloitte’s website and research what ancillary services are offered and not mandated by the ICANN RPMs (in response to Question 2(a))
  3.  Staff to note the action of sending Question 6 to Deloitte in the summary document.

Notes


  1.  Question 2: What information on the following aspects of the operation of the TMCH is available and where can it be found?
a) Ancillary services offered by the TMCH which are not mandated by the ICANN RPMs, including but not limited to: i. the post-90 days’ ongoing notification service; and ii. other services in support of registry-specific offerings
b) With whom and under what arrangements does the TMCH share data, and for what non-mandated RPMs purposes?


  *   Question 2(a) sounds a bit confusing. It should include a drop down of ancillary services offered by TMCH.
  *   Question 2(b) sounds like a privacy policy question. It should be expanded to include more related questions, e.g. do you notify registrant when sharing data?
  *   Question 2(b) is designed to ask who else does TMCH share data, and for what non-mandated RPM services, so it does not sound like a privacy policy question. Nevertheless, additional privacy policy questions can be incorporated.
  *   What are we trying to get from this question? This question will help us understand what we do not know about. The information we are seeking here is about other services offered by the TMCH, using data submitted, for the purposes of the RPMs.
  *   We previously asked TMCH Providers a number of questions, so we should avoid repeating the same questions and craft the questions if we know what we are missing.
  *   Staff is a bit concerned about redrafting the questions now rather than focusing on whether we already have, or can get, the information from Deloitte (TMCH Provider), since the WG discussed these questions at a full WG meeting. Clarifying the intent of the questions may be helpful to Deloitte, but the questions as they stand were discussed by the WG.
  *   Question 2 is not included in the Data Table forwarded to the vendor responding to the RFP. Question 4 (targeting Trademark & Brand Owners) and Question 5 (targeting Registries & Registrars), as agreed by the Sub Team, are included in the Data Table for the survey purposes.
  *   With regard to 2(a), Sub Team should look at the TMCH Provider’s website and review what services are available.


  1.  Question 6: What role does the TMCH Provider (front-end) play in “servicing” the Additional Marketplace RPMs? For example:
• What services do you provide to ICANN Registry Operators?
• Does the TMCH use any data from the Clearinghouse to provide these services? If so, please explain.
• How are you compensated for the provision of these services?


  *   This question has already been covered during the session meeting with Donuts at ICANN61.
  *   It is reasonable to ask this question, but we should be asking what we may not know about, and not about the Sunrise and Trademark Claims services.
  *   Donuts is the only Registry Operator right now that provides Additional Marketplace RPMs, besides Deloitte (not a RO but as the TMCH Provide – Deloitte now runs the MMX ones).
  *   This question can be teed up for Deloitte, so we will have more complete responses.


  1.  Question 1: How, and to what extent, does use of Protected Marks Lists (e.g. blocking services) affect the utilization of other RPMs, especially Sunrise registrations?


  *   This question will be dealt with when we receive responses of other questions.


  1.  Sunrise and Trademark Claims Survey Update

  *   Staff are in process evaluating proposals submitted and engaging with the participating vendors. It is a confidential process led/managed by the Procurement Department. Staff will keep the Sub Team posted with the progress and report back information that can be shared as per Procurement Guidelines.
  *   Staff aim to complete contracting process in May according to timeline, and kick off the survey project as soon as the vendor is contracted. The selected vendor will then engage quickly with the Data Sub Team to finalize the survey questions, which the full WG will hopefully also quickly agree with, so we can send the survey out.
