Hello Beth,

Thanks bringing this up in an email rather than at the IRT meeting.
This will allow us to focus on the IRT meetings on the substantive discussion on the policy implementation.


  1.  There is no expected timing from the board on this. The Board is aware of the IRT’s statement to the GNSO Council to come up with the timeline after the recommendations analysis is completed adequately.
  2.  GAC on the other hand does have a clear expectation from the IRT which was published as a part of its GAC Communiqué – Montréal, Canada.

     *   The pertinent part is here: “2. Domain Name Registration Directory Service and Data Protection With regard to Phase 1 of the EPDP,
a. The GAC advises the Board to:

i. Take all possible steps to ensure that the ICANN org and the EPDP Phase 1 Implementation Review team generate a detailed work plan identifying an updated realistic schedule to complete its work and provide and inform the GAC on the status of its progress by January 3, 2020;”

     *   It’s important to note that GAC advice is made to the Board, not to the implementation team directly. Therefore, does not constitute an official action for the implementation team.
     *   The timing of the Board consideration for this advice won’t be until mid-January 2020 so I do not expect to receive a Board direction on this till after the GAC’s requested date of January 3, 2020.
     *   We, however, will prepare a realistic schedule as part of our existing plan,  We’ll see how close we are with the analysis completion to estimate the timeline with a brief discussion tomorrow.
     *   We are fortunate to have Laureen, a GAC member,  who could provide further insight to the IRT if needed.
  1.  The point about delivering the impact assessment to the GNSO Council is Rec 27. Nothing new here for us. This is to advise the contractual compliance enforcement.  We continue to work on Rec 27 and keep the IRT informed.

I am particularly interested in seeing your inputs for the “6-month implementation period.”
If there is an argument for changing this default 6-months, let’s capture that in writing as we’ll need them for public comment also.

Hello All,
I wanted to follow up on Dennis’ email below and thank Dennis for flagging it for us. I have one question on this and one comment. First, Dennis, do you know what the expected timing is on these items? Are they simply to be included with our IRT Report?

Second, as the GNSO is the genesis of the Thick WHOIS Policy and ICANN was responsible for deferring its implementation, I would suggest that we simply note the direct impacts of the Final Report Recommendations on the text of the Policy (as is already required by Rec#27), but defer to the GNSO for any action. I think that process is clear from the Resolution language, but I think it’s important that the IRT resist the urge to offer any opinion or advice as that is the role of the GNSO.
