[NomComRIWG] From the NomComRIWG: Follow-up to the GNSO on Recommendation 10

Dear members of the GNSO,


On behalf of the NomComRIWG we are writing to provide an update on implementation of Recommendation 10, NomCom rebalancing.


First, we would like to thank the GNSO SG/C chairs for joining the NomComRIWG plenary meeting #86<https://community.icann.org/pages/viewpage.action?pageId=164626772> to discuss the proposed Bylaw changes relating to Recommendation 10 the ‘rebalancing proposal’. Based upon these discussions, it became clear that several constituencies in the GNSO held strong objections to the  proposed Bylaw change. It also became clear that the stakeholder groups of the GNSO are not in a position to conduct an internal rebalancing exercise at this time.


During plenary meeting #87<https://community.icann.org/pages/viewpage.action?pageId=170787271>, the NomComRIWG agreed to withdraw its proposed Bylaws changes on Rec.10 rebalancing. The NomComRIWG notes the significant time and effort that it devoted to an attempt to resolve the rebalancing issue, but the ensuing conversations made clear that significantly more time needs to be devoted to this issue at a broader community level.  As a result, removing the rebalancing portion of the proposed Bylaws changes will hopefully allow the other implementation work of the NomComRIWG to conclude successfully.


In light of this decision, the NomComRIWG does not believe it needs to move forward with further community consultations on the proposal that it put forward. The NomComRIWG will update its implementation plan to reflect this change, noting that work on Recommendation 10 has concluded without the recommendation being implemented. This will be reflected in the NomComRIWG’s Final Status and Progress Report being submitted to the OEC in December 2021.
