Appendix X of the registry agreement defines how a registry operator can
register a name in its own right.

Appendix X for .com states:

"Names Registered to Registry Operator

The domains to be registered by Registry Operator, other than on a
request submitted by a registrar pursuant to that registrar's
Registry-Registrar Agreement, are as follows:
