The GAC would welcome discussions with the review team, and with the broader community, on these principles. * Consistent with these principles, the GAC highlights the broad range of national legislation and bodies of law potentially relevant to the WHOIS service, including: privacy and data protection laws; consumer protection law; intellectual property law; various forms of criminal law; and so on. For these reasons, the GAC would recommend that the review team's definition of 'applicable laws' be drafted a way that can account for all relevant laws. * The GAC looks forward to further discussions with the review team at the upcoming ICANN meeting in Singapore. Please let me know if there are any questions arising from this, or if there is anything you would like me to follow up further with the GAC. I think the paper is starting to look very good, and one that will hopefully draw out some useful community feedback. As you'll see, I've noted a couple of questions that I think we'd already agreed to delete, and also proposed an additional sub-component to one question which I'd be very interested to get community feedback on. I've also commented on the proposed 'costs' section of the paper, which I have some questions and concerns about. I look forward to reviewing the version that comes out of tonight's call asap after its available. Edits were made up to the end of the second question box on page 5, as marked in the attached version. The list of consensus policies was moved above the first question box and the team decided to include hyperlinks to main documents. PLEASE NOTE: When adding the hyperlinks, I noted that items 3 and 4 in the consensus policy list on page 4 seem to relate to the same instrument, notably the WHOIS Marketing Restriction Policy, so I reflected that in the drafting, marked by red. The list of consensus policies was moved above the first question box and the team decided to include hyperlinks to main documents. I agree that the paper is looking great -- and now it is time to finish it and get it out for public comment (this week is the deadline!). That gives the Community a chance to see our issues and questions, and an opportunity to prepare notes for our discussions in Singapore (as well as prepare written comments for afterwards). ** Two quick notes: (1) I asked Liz Gasster to review the "Clarity of existing policy" section, and she found I/we had left out something -- a consensus procedure called " 'Handling WHOIS conflicts with Privacy Law' (effective January 2008) which details how ICANN will respond to a situation where a registrar or registry indicates it is legally prevented by local/national privacy laws or regulations from complying with the provisions of its ICANN contract regarding the collection, display and distribution of personal data via WHOIS. The procedure is for use by ICANN staff and did not change the obligations of registries, registrars or third parties when approved by the GNSO and adopted by the Board." I have included the text above at the end of the Clarity of existing policy. For those who passed it, it was seen as a small step for ICANN since it did not allow registries and registrars to pro-actively bring themselves into compliance with laws, but only to wait until they are called out as being in violation. So it was seen as a first step, but a small step. Nonetheless, Liz is right in advising that we might include it -- so I have done so subject to your approval -- to the changes already circulated by Peter on the current draft. (2) Alice and Olof -- will it be possible to insert links to all of the policies and procedures in the final version so people can easily find them?? Tx you! So I won?t be able to attend that, and it is possible that some other GAC members may be in a similar position. I don?t know how locked in this meeting is, but is it possible to try to change it? Our priority has to be to complete our work on the Issues Paper, and have it published for comment prior to the Singapore meeting, as it will effectively be the agenda of our outreach meetings during that ICANN meeting. What worked very well previously was when everyone gave some time to reviewing the paper and sending comments to the list by the Monday before the call. That way, we can hopefully close off a couple of issues, and also understand areas where there are different views. So, I'd like to encourage everyone to do the same this time. To that end, Alice, please can you circulate the latest version of the paper, updated since our last attempted call. Kathy and I have been discussing a suitable agenda for our face to face, and this is our ideas so far. Kathy suggested that it would help us all prepare to have a detailed breakdown of what we hope to accomplish under each agenda item. I would be very pleased to have your reactions and agenda suggestions. Sharon Sharon LEMON OBE Deputy Director Cyber and Forensics Serious and Organised Crime Agency (SOCA) 07768 290902 0207 855 2800 -----Original Message----- From: rt4-whois-bounces at icann.org [mailto:rt4-whois-bounces at icann.org] On Behalf Of Kathy Kleiman Sent: 07 June 2011 14:53 To: rt4-whois at icann.org Subject: [Rt4-whois] Some News from Kathy Dear All, I wanted to share some news. As some of you might know, I am no longer with PIR. I certainly loved being there, but have moved on to other projects (please see statement below). I delayed in sharing the news with you because we were uncertain of my status within the Review Team. It is the one area I was most concerned about because we are a team, and I did not want to leave midway through our very important work. I value working with you everyday, and I know that our work serves a very important purpose for ICANN, for the Community and for the Internet. With ICANN Staff, David Maher (chair of the Registries Stakeholder Group) and others we reviewed the appointment to the Review Team. Is the appointment a personal one or a representative one? In the end, I asked David Maher to return to the Registries Stakeholder Group to ask if I should continue or if a current-Registry-representative should be appointed. I wanted to share that it looks as if the Registries will be appointing a new representative; they have asked for volunteers amidst the fulltime Registry community. Emily and I will let you know of their response. Let me share with you my departure statement below, and while I am not saying good-bye yet, I truly want to share with you my great respect and appreciation for every member of our Team, and for our incredible collective effort. We are creating new ground, and I think we are doing it well. All the best, Kathy ------------------------------------------------- The Public Interest Registry announced today that Kathy Kleiman, the Director of Policy, resigned from her position with the company effective May 6, 2011. Kathy leaves PIR to finish her documentary on the work of the ENIAC Programmers, the six women who programmed the first all-electronic, programmable computer during WWII. With the passing of Jean Bartik on March 23rd, Kathy felt it was critical that she finish her long term project in this area and share this powerful story. PIR appreciates Kathy's contributions to .ORG and the public interest and wishes her well. Kathy can be reached at kathy at kathykleiman.com. Her ENIAC Programmers Project can found at www.eniacprogrammers.org. Like me, you value her contribution to the team as Vice Chair, her deep knowledge of the ICANN WHOIS history and enjoy working with her. On an issue as divisive as the WHOIS, it is a challenge to bring together a cohesive team, which is capable of working in cooperation whilst respecting the diversity of views. I believe that we are well on the way to achieving this. Like me, some of you have expressed confusion about what the process is in this sort of situation. In order to gain a better understanding, I have today written to the selectors of the Review Team, Rod Beckstrom and Heather Dryden, to ask for clarification in this regard, and also to the Chair of the Registries constituency. I have requested that the Review Team be allowed to make representations in the event that a replacement is requested. Of course, we are not in control of the selection, and will respect the wishes of the selectors and the ICANN community. However, I am sure that you would join me in seeking clarification of the process, and to request some input into it. Kind regards Emily 76 Temple Road, Oxford OX4 2EZ UK telephone: 01865 582 811 mobile: 07540 049 322 emily.taylor at etlaw.co.uk www.etlaw.co.uk -------------- next part -------------- An HTML attachment was scrubbed...
