Having been member of "AL" Sub-Team I do accept GAC's position, but still I am not quite sure how IP law can affect WHOIS policy and it implementation -> good point for further discussions.

Dear review team colleagues,

The GAC has asked me to forward the following comments to the WHOIS review team:


*         The GAC is interested in the work of the WHOIS review team and looks forward to further engagement and consultation as the review progresses.



*         The GAC would like to draw the review team's attention to the 2007 GAC Principles regarding gTLD WHOIS services, which identify public policy issues and propose principles related to generic Top Level Domain WHOIS services. The GAC would welcome discussions with the review team, and with the broader community, on these principles.



*         Consistent with these principles, the GAC highlights the broad range of national legislation and bodies of law potentially relevant to the WHOIS service, including: privacy and data protection laws; consumer protection law; intellectual property law; various forms of criminal law; and so on. For these reasons, the GAC would recommend that the review team's definition of 'applicable laws' be drafted a way that can account for all relevant laws.



*         The GAC looks forward to further discussions with the review team at the upcoming ICANN meeting in Singapore.

Please let me know if there are any questions arising from this, or if there is anything you would like me to follow up further with the GAC.
