It has an interesting call to the Review Team: "To reiterate, the ALAC believes that this Review Team, whether embracing or rejecting several related principles, must pronounce its decisions unambiguously. It is our view that this Team must treat with and declare (1) whether the WHOIS construct as originally devised and for the purpose intended is still necessary, (2) whether the WHOIS dataset as originally determined remains fit to its original purpose, and (3) whether the several identifiable uses made of both the WHOIS data and processes that have expanded the original intent are useful and in the public interest." http://forum.icann.org/lists/whoisrt-discussion-paper/pdfnmzuH1VmUy.pdf FYI and best, Kathy -- From jbladel at godaddy.com Tue Jul 26 17:31:19 2011 From: jbladel at godaddy.com (James M. We stumbled upon a interesting problem: Legal classification of statically assignd IP addresses is going to change. Currently all IP assignments are classified as call detail records. There is a strong movement to reclassify those as master data. As an implementor of access technology we choosed to distinguish clearly between those data models. Resellers are able to set the master data record to "static", but which IP is really assigned, is not available to them. Of course they can research IP adress assignments on LEA requests, but that's different issue. The implications to Whois should be clear. For anyone not with us last night on the call, Olof divided up the public comments (26!) by response to questions that we raised. It's a great way to review the materials. We also appointed a small group to do a "deep dive" into the comments. While we all want to read them, they will read them very closely and provide assistance to the people writing chapters. /*The group is currently Susan, Micheal and Kim (tx you!). Would anyone else like to join? */ Re: the reference from MM below, that is Professor Milton Mueller of Syracuse who runs the Internet Governance Project and shared with us a report written by this organization -- so the link may lead to something quite useful. MN, Michele Neylon had some interesting comparisons of Whois data across countries -- here's a registrar with lots of ccTLD work too -- so a nice bridge of gTLD and ccTLD info. I was given paragraph 5 to work on by Emily - What do the terms law enforcement, applicable laws, producers and maintainers mean and what comments, from whom, we have recieved on them, and then to come to a final conclusion.. This is where I need your knowledge and experience to comment on whether the comments we have received should influence our original definitions. I am new to the community so have no real idea of the relevance of the group, whether they have any particular agendas etc. For ease of reading, I have shown each our definitions with a brief summary of comments received, and from whom - with the full comments as as Annex. I have also added the Law Enforcement comments as Annex B. So - could you please take time to have a look - it is only a quick read and send back any comments you have as tracked changes. Particularly I would like Lutz and Kim to have a look at the feedback on the law enforcement definition as we were on the original small sub group. And Peter, do you have any additional feedback from law enforcement from the GAC? If you could let me have any feedback by 31st July that would be great, Many Thanks, Sharon Sharon LEMON OBE Deputy Director Cyber and Forensics Serious and Organised Crime Agency (SOCA) 07768 290902 0207 855 2800 This information is supplied in confidence by SOCA, and is exempt from disclosure under the Freedom of Information Act 2000. With respect to your specific question, I tend to agree with some of the comments (especially from your LE colleagues), i.e., that the definition is a little broad. We had originally drafted it more narrowly, but then ended up broadining and generalizing it more. Having said that, however, I do not see how we can possibly include private entities without losing all of the consistency of the definition itself, i.e., without it falling apart and also just limiting it to sworn law enforcement officers. That is not appropriate considering that regulatory officers, at least in Canada, are not sworn law enforcement officers. Further the definition talks about "Law Enforcement Entities" and not law enforcement officers as seperate item. I think, the defintion could be tightend up by changing the last part: "...government-imposed legal obligations" to something more narrowlly such as "...government regulations" or some such thing.
