Designing a system with this requirement will mean that CPHs will require that ICANN enters into a legal agreement with CPHs to provide indemnification for any fines incurred due to infractions to GDPR that are caused by the release of private data through this system. Without this agreement, CPHs will be unwilling to return private data to this system.

Can anyone speak for ICANN’s willingness to enter into this type of agreement? If not, going forward with the design of this type of system might not make sense.

Thanks,
Jody Kolker
