[bc-gnso] Update on Closed Generics gTLDs: policy work will NOT proceed

We received this update from the Chairs of GAC, GNSO, and ALAC, regarding the Facilitated Dialogue for Closed Generics gTLDs:
They will not to proceed with further developing a final framework for possible policy work on this topic.

Highlights of the attached letter to the Board:

  *   we believe that it is not necessary to resolve the question of closed generic gTLDs as a dependency for the next round of new gTLDs
  *   for the next round, the Board should maintain the position that, unless and until there is a community-developed consensus policy in place, any applications seeking to impose exclusive registry access for "generic strings" to a single person or entity and/or that person's or entity's Affiliates (as defined in Section 2.9(c) of the Registry Agreement) should not proceed.
  *   any future community policy work on this topic should be based on the good work that has been done to date in this facilitated dialogue.

Subject: FOR YOUR INFORMATION: Update on Facilitated Dialogue for Closed Generics gTLDs
On behalf of the participants in the ALAC-GAC-GNSO Facilitated Dialogue on Closed Generic gTLDs, thank you for submitting feedback on behalf of your groups to the draft framework that the dialogue participants published in June for community feedback. As a follow up to that feedback exercise, the dialogue participants have requested that staff transmit the attached 7 July 2023 letter from the ALAC, GAC and GNSO Chairs for your information, as it outlines the three Chairs’ collective decision not to proceed with further developing a final framework for possible policy work on this topic.

The Chairs have also requested that the dialogue participants document their work and produce an outcomes report in closing out this project. In this regard, the dialogue participants wish to invite the drafters (or appointed representative) of those commentators that would like to do so to join the next Closed Generic gTLDs dialogue call, scheduled for Monday 21 August at 20:00 UTC, to engage with the dialogue participants on any aspects of your group’s feedback that you think may benefit from further explanation or clarification.

If we may, staff would like to note that in coming to their decision not to proceed further with community work at this time on Closed Generic gTLDs, the three Chairs took note of and expressed appreciation for the community’s willingness to provide feedback on the draft framework. At the dialogue participants’ direction, staff will ensure that the community input is fully incorporated into the outcomes report that we are currently drafting for the group to review. We will also emphasize that the draft framework is not a final agreed outcome of the dialogue, and that any future community work on this topic should take into account the concerns that have been expressed by the community as well as the fact that the draft framework is a result of compromises reached for the purpose of delivering a preliminary document for community input.

If the drafter(s) of your group’s comments, or an appointed representative of your group, wishes to join the dialogue participants’ call on Monday 21 August at 20:00 UTC, please notify the GNSO Secretariat at gnso-secs at icann.org<mailto:gnso-secs at icann.org> so that they can send the call details to the relevant persons.
