Knowing the line of commentary that Marilia normally follows, I am almost certain she was referring to market distortions on the domain names industry, not what David is interpreting below.

Further to the email from Marika, we have reviewed the transcript from Helsinki as per the action items from the last meeting. The query regarding not using funds to distort competition came from Marilia Maciel:
“And in terms of recipients as well, I think that one important
point is that this money does -- is not given to -- to a project or
something that will distort competition inside ICANN itself. I
don't know how to -- how this could be represented in the
charter but I think that a guiding line for us should be that this
should not distort competition inside the organization.
So I take the point on -- on the market, the DNS market, but I
think that we need to be very careful about that.”

Upon reviewing this staff suspect she is referring to any project that would directly compete with ICANN, for example by creating an alternative root or something like that. This issue may be something for the CCWG as it relates to how the funds are used. However, should you wish us to follow-up for more information we would be happy to do so.

Proposed Agenda – new gTLD Auction Proceeds Drafting Team Meeting – 10 August 2016


1.      Roll Call & Welcome

2.      Review timeline and discuss approach proposed by Sylvia to move forward (see timeline attached)

3.      Continue review of comments on draft charter (see latest version of comment review tool attached))

4.      Confirm time / date of next meeting

ACTION: Staff to try and clarify the meeting of Comment 8 from Helsinki meeting, does this mean not funding projects which fund competition in the market place then this is valid?
ACTION: Sylvia to circulate language which had been removed specifically prior to Helsinki meeting
ACTION: (i) DT to finalise Mandatory and enhanced statements of interest language and then board members seek input from board group, (ii) DT to determine content of mandatory SoI and criteria for inclusion/exclusion from CCWG and (iii) Deal with mission and conflict of interest issues as a whole rather than separately.
