I am pleased to accept the nomination.

My SOI:

Statement of Interest---


I represent the domain investors/developers of the Internet Commerce Association in my role as Counsel and serve as their representative on the Business Constituency. I have also provided counsel to new gTLD applicants and to other parties with issues pertaining to particular applications, as well as other clients with an interest in ICANN matters.  I also serve as a member of the Internet Committee of the International Trademark Association and its Internet Governance Subcommittee.

I have joined this working group with a view that ICANN policies and practices should protect recognized legal rights but that ICANN is not a legislature or treaty body with the power to create new rights. I also believe that any arbitration dispute resolution process must accord meaningful substantive and procedural due process rights to both the complainant and respondent including a meaningful right of appeal. I have no preconceived idea as to what conclusions this WG should reach and will carry out my Co-Chair duties in an evenhanded manner that treats all participants equitably.

Many thanks for your confidence in considering me as a potential co-chair.  Regrettably, however, I must decline such a nomination. I'm afraid I'm overextended with ICANN work as it is, and complex as this matter is, it deserves a co-chair with a bit more bandwidth.

As discussed, the complexity and nature of the work means that having more than one co-chair would likely ensure greater fairness and diversity in representation in the WG leadership, and allow for more effective and efficient management of the WG workload and meetings. For ICANN staff:

  2.  Provide update on current status of prior IGO-INGO PDP recommendations and Board/GAC/GNSO discussions (staff will send an update to this mailing list within the next week)
  3.  Invite WIPO and the National Arbitration Forum (NAF) to make brief presentations on the UDRP and URS to the WG
  4.  Invite interested IGOs and INGOs to provide information/make a presentation to the WG on their experiences/problems with using the UDRP and URS
  5.  Prepare a chart/grouping of all the Charter questions, to form the basis of a draft Work Plan
  6.  Compile list (starting with George’s initial suggestions) of possible resources for WG data gathering and research, to be posted to the WG’s wiki space
For WG members:

  1.  Nominate candidates for co-chairs (see above)
  2.  Familiarize yourself with the WG Charter, GNSO Policy Development Process (PDP), WG Guidelines and other background information; these can all be found on the WG wiki space: https://community.icann.org/x/37rhAg (note that all the MP3 recordings, public Adobe Connect chat history and meeting transcripts will also be posted to the wiki after each call)
  3.  Respond to the Doodle poll for the next meeting, when this is sent
  4.  Identify expertise/contacts for any of the WG Charter topics (per Petter’s last email to the list)
